End-User License Agreement (EULA)

This End-User License Agreement (“Agreement”) is a legal agreement between you (“User” or “you”) and Greater Equality Sports LLC (“Company,” “we,” “our,” or “us”) governing your use of the GearGiver Sports mobile application (“App”) for iOS and related services.
By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not install or use the App.
1. License Grant
Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App solely for your personal, non-commercial use on Apple-branded products that you own or control, as permitted by Apple’s App Store Terms of Service.
2. Restrictions
You agree not to:
• Copy, modify, reverse-engineer, decompile, or disassemble the App or its components.
• Use the App for any unlawful or harmful purpose.
• Rent, lease, lend, sell, redistribute, or sublicense the App.
• Circumvent any security features or interfere with other users’ use of the App.
3. User-Generated Content
The App allows you to upload or share photos and descriptions of sports gear. By submitting content, you grant Greater Equality Sports LLC a worldwide, royalty-free, non- exclusive license to display and distribute that content for the operation and promotion of the App.
You represent and warrant that you own or have rights to the content you upload and that it does
not infringe the rights of others.
4. Account and Authentication
You are responsible for maintaining the confidentiality of your login credentials (including thoseprovided by Google or Apple). Any activity under your account will be deemed authorized by you.
5. Payments and Transactions
All payments for shipping or other transactions are processed by third-party providers (e.g., Stripe). We do not store your full payment data. Your use of those services is subject to their own terms and policies.
6. Data Collection and Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.
7. Termination
We may suspend or terminate your access to the App if you violate this Agreement or engage in activities that harm the Service or other users. Upon termination, you must stop using and delete the App from your devices
8. Intellectual Property
The App, including its design, software, and trademarks, are owned by Greater Equality Sports LLC and protected under applicable copyright and trademark laws. This Agreement does not transfer any ownership rights to you.
9. Disclaimer of Warranties
The App is provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted or error-free operation. To the maximum extent permitted by law, Greater Equality Sports LLC disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement
10. Limitation of Liability
To the fullest extent allowed by law, Greater Equality Sports LLC and its affiliates will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the App, even if advised of the possibility of such damages.
11. Apple-Specific Terms
This Agreement is between you and Greater Equality Sports LLC, not Apple Inc. (“Apple”).
However, you acknowledge that:
• Apple is not responsible for providing maintenance or support for the App.
• Apple is not liable for any claims related to the App, including product liability, legal
compliance, or consumer protection.
• In the event of any third-party claim that the App infringes intellectual property rights,
Greater Equality Sports LLC, not Apple, is solely responsible for investigating and
resolving such claims.
• You must comply with applicable third-party terms when using the App.
• Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce
it against you
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflicts-of-law rules.
